Raven, perhaps you could more clearly define YOUR definition of Warez. I think that is the issue.

'One man's junk is another man's treasure.'

Is Ad-Aware? Is .rar beta?

Define it, please.

Raven,

I think you are issuing an order, but asking for opinion ... Bad policy, IMHO.

Also, I believe YOU need to clearly define what warez IS to YOU.

Frankly, Raven, if it is there, and downloadable ... with the prices these corporate geeks are asking, I say hell with 'em.

Not trying to be disrespectful ... Thanks for letting me offer an opinion.

There's a very simple way you could define it - it it's legal, it's allowed... Downloading the free "personal version" of AdAware is legal. It is allowed. Downloading a cracked version of 3DS Max 6 is illegal. It is not allowed. It's not exactly a blurry line, and it should be pretty obvious that if you're downloading it from www.hax0rdappz.ru (made up URL, I hope!) you shouldn't be talking about it here...

Wrong answer. I have. Wink

As for the "What is warez" questions... IIRC, Raven has explained before that using software in any manner not specified in the license is warez. Downloading a hacked version of something is obviously warez. But, using software past the end of the evaluation period without registering it is also warez. Another example would be discussing a no-cd crack for BC (even if you legally own a copy). It's warez because the license explicity states that it must run from the cd.

Rex, while I can respect that view and see its wisdom, the software companies brought this onto themselves with ridiculous prices.

It's like the medical/phamacuitical industry. Hell with 'em (as long as you asked my opinion by posting this debate thread).

Its also a well big "SCREW YOU" to the ball-busting programmers that live in front of computers clicking away for very little money. If you want to specifically screw the execs then you steal the software and send $10 to all the program staff.

Just to clarify my position - I'm taking no stance on the matter beyond what the rules say... I'm acting as staff, not as my own opinion. All I will say of my own opinion is that I have a great deal of respect for companies like Lavasoft (AdAware) and GriSoft (AVG) for "getting it" - ie, they understand that free personal-use software is good, while making businesses pay for it is fine...

Pegasus, Winrar ain't free. It says-

"Please note that Winrar is shareware.
After a 40 day trial period you must either
register it or remove it from your
computer."

and

When you purchase WinRAR/RAR from any of the sites around the world, you are sent a personalized key file that you copy on your computer that tells WinRAR/RAR you are the legal owner of that software and registers it to you. If you purchase a copy, and didn't receive a key, contact the site you purchased it from, they can resend it.

WinRAR/RAR products are not free! They are shareware, which means you can try the software at no charge for 40 days, and purchase it then if you choose to keep it.

Heh.

Thanks, Rex ... I have some strong views on this and saw the warnings go flying around ... As a site mod and admin, I also see the need to protect a company from liability. Hell, its the forum and Nightsoft that is held liable if traficked here with links to Warez.

I think Raven is doing the right thing for the COMPANY.

But, can the companies making these ridiculously-priced programs act like GriSoft and .rar and others and do the right thing? Or will they continue to put the programmers and the code slaves in the middle?

It's corporate cuthroat, I'm afraid ... They did it, now we have to clean up the mess?

Using a trial version past it's expiration date without registering/purchasing the software is warez. Using a keygen to generate a key is also warez. It's kinda like having an unscroupulous locksmith make a key to a house or car you don't own.

There. See, that is where it gets shady. .rar offers beta FOREVER. They don't care, and now its warez?

Geez.

They know how to turn that off ... 'they' should do it.

Hmmm.

Ok, this has become a philisophical debate. Though I may have opinions on the right or wrong of software prices, I will not share them here. That would not be appropriate, unless those companies are given the right to slander our prices as well.

What I will say is that any modification that allows you to use the software past the trial date is warez, period. Once the trial ends you either pay for the software or stop using it. That is the intention of a trial.

Now, I am not a priest. If you choose to break the law, that is on you. It is your choice. Just don't share it with my patrons on my board. I would, of course, recommend against it, but it is your choice to take the chance if you so wish.

Well, for me, I downloaded the Trial version, and after the 40 days, it never stopped me from using the program, it asked if I wold like to regester, I say No and it continues letting me use it.

Ok, if the EULA does not require you to register after the period........IE, the author says something like "Shareware is not free. Though the program continues to work after the trial period, you are expected to pay for the software if you choose to use it. Paying for it will allow us to make better versions in the future and to continue to support the product.......", or something along those lines, then no, you are not LEGALLY obligated to pay for it.

Best thing I can say is read the EULA. That will answer all of your questions.

what if someone is using a time limited shareware program "past" its expire date by setting his computer clock back so that the program thinks it's not time to expire yet?

If the program stops working because the eval period is over, and someone takes steps to bypass that limitation witout registering the software, then I'd call that warez. A program that stops working after X amount of days is an obvious indication that it's not ok to keep using it after that amount of time.
